Industrial Regulations

All commercial oil tank installations over 200 litres must be bunded, ie have a secondary containment capable of holding 110% of the maximum contents of the tank. The category commercial includes factories, schools, churches, public buildings, hospitals, shops, offices, etc.

In England, all oil tank installations must comply with The Control of Pollution (Oil Storage)(England)2001 regulations. These are enforced by the Environment Agency (EA) who may make a routine inspection from time to time. The other group of people increasingly interested if your oil installation complies are your insurance underwriters who will also be looking to ensure the installation complies with Building Regulations. Any loss of product would most certainly involve a significant clean-up operation and can be very costly to deal with.

The EA consider any loss greater than 5 litres from your own perimeter a reportable loss. Failure to inform the EA may, depending on your operation, result in a significant fine, remediation costs and public disclosure of your business name and address which could result in adverse publicity.

Under the Public Health Act 1961, Section 73, where the premises are occupied, it is the responsibility of the occupier to take all reasonable measures to ensure the tank is rendered permanently safe. When there is no occupier, the landowner bears responsibility.
